Fact Sheet: Supplement-not-Supplant under Title I of the Every Student Succeeds Act
On August 31, 2016, the U.S. Department of Education (USED) released proposed regulations for the Title I requirement of the Elementary and Secondary Education Act, revised by the Every Student Succeeds Act (ESSA). This overview provides an overview of the “supplement-not-supplant” provision that stipulates Title I funding be used to support students in high poverty schools, and not for making up school funding shortfalls. The revision in ESSA clarifies how school districts can demonstrate compliance, using methodology that allocates state and local funds to each Title I school, ensuring Title I schools receive all the state and local funds it would otherwise receive if not a Title I school. This Fact Sheet provides suggestions for how districts can meet compliance with this provision and flexibilities provided to districts, including recommendations from USED on demonstrating compliance.
