Non-Regulatory Guidance: English Learners and Title III of the Elementary and Secondary Education Act (ESEA), as amended by the Every Student Succeeds Act (ESSA)
The Every Student Succeeds Act moves several provisions related to English learners (ELs) from Title III to Title I, Part I. This guidance addresses how Title III funds might be used to provide supplemental services for the improvement of EL students’ English language proficiency and academic achievement. Services provided to ELs with Title III funds must supplement, not supplant, services that must be provided to ELs under Title VI of the Civil Rights Act of 1964, the Equal Educational Opportunities Act of 1974, and other state and local requirements.
